Legal aid

At legal options we are able to assess your eligibility for Civil/family legal aid and help you find a legal aid lawyer.

What is civil/family legal aid?
It is help with legal costs for private disputes and non-criminal problems that may go to court. If you can’t afford a lawyer you may be able to get one through legal aid. You may have to repay some or all of the cost of legal aid.

Will I qualify?
The Legal Services Agency (LSA) makes a decision based on:
  • Your financial situation
  • What sort of legal problem you have
  • Whether it is fair and reasonable for your case to proceed.

What information has to go in the legal aid form?
  • Details of the case you are wanting legal aid for
  • Details of the other person(s) involved
  • Your contact details at home and work
  • Your date of birth
  • Your income for the last 12 months
  • Any savings you have
  • The value of any major assets you have like a house and car
  • Any money you owe
  • How many dependent children you have
  • If you have a partner (married/de facto) you need to give the same kind of information about their finances

What do I take when I see the lawyer at legal options?
  • Any documents or letters about your case
  • Proof of all earnings for past 12 Months (e.g. pay slips)
  • Rates notice (if you own a house)
  • WINZ number and details of your benefit (if applicable)

How will I know if I get legal aid?
You will be sent a letter telling you whether or not you have been granted legal aid. If you have, the letter will also tell you the amount you may have to repay.

What happens if I am not happy with the decision made about my application?
You can ask the agency to reconsider its decision. legal options can assist you with this process.
